Man beaten in Las Vegas casino bathroom sues for negligence

A man who was badly beaten while staying at a Las Vegas hotel and casino in 2010 has filed a personal injury lawsuit against the casino, accusing management of failing to prevent the assault by providing proper security. His attorney says the man suffered bleeding on the brain and subsequent loss of cognitive function as a result of the attack, which took place in a restroom.

The man, a resident of Hawai'i, visited the Main Street Station casino with his wife in May 2010. Main Street Station markets heavily to Hawai'i residents. An annual report by its parent company, Boyd Gaming, says that 55 percent of people staying at its hotel last year were from that state.

Around 3 a.m. on May 26, the plaintiff, now 70, went to a men's room near the casino floor. While inside there, he was attacked by a large man who knocked his head into a urinal and robbed him of his wallet. Following the incident, the man was rushed to intensive care with skull fractures and bleeding on his brain, which required multiple surgeries.

According to the lawsuit, Main Street Station negligently allowed the assault to occur by keeping the hallway between the casino and the restroom long and poorly lit. The man and his wife are asking the casino for unspecified damages.

Boyd Gaming declined to comment on the litigation. The police report noted that surveillance cameras at the casino helped officers catch the man who eventually pleaded guilty to assaulting the plaintiff.
