Family of murdered man accuses casino of negligence

The North Las Vegas casino where a man was shot and killed by a would-be robber in 2010 might have prevented the killing if it had had provided better security, according to the family of the victim. The shooting is the subject of a personal injury lawsuit filed recently against the Opera House casino as well as the man alleged to have committed the crime.

According to media reports, on Oct. 22, 2010 the victim was visiting the Opera House when another man at the casino robbed another patron of $200 using a handgun. Police say the gunman then entered a men's room that the victim was using. The man demanded money but the victim said he did not have any. The defendant then shot him several times, according to the person who was robbed and witnessed the shooting.

In a personal injury suit filed on Oct. 22, the family of the murdered man says that the Opera House was partly responsible for the incident because of faulty security at the casino. The suit says that the Opera House failed to install security videos in the restrooms or hire enough security personnel. The necessity of such security measures was well-known to Opera House management because of "prior incidents of multiple similar wrongful acts" at the casino, the lawsuit says.

The family is seeking unspecified damages. The Opera House's parent company, Fifth Street Gaming, declined to comment, citing company policy. The man accused in the shooting, who is also a defendant in the civil suit, is scheduled to go on trial in the criminal case on Nov. 13.
