The Act club says contract dispute was contrived to evict them

For years the popular adage “What happens in Vegas, stays in Vegas” has been used to describe the city’s adult nightlife. Las Vegas often pushes the envelope with racy advertisements and entertainment, but some casino executives believe that the line has been crossed and are trying to put a stop to it.

The Act, a nightclub located at The Palazzo hotel and casino, has filed a business litigation lawsuit against Las Vegas Sands, the owner of casino, to stop an eviction of the club. According to the suit, The Act was informed that their show was too raunchy for the venue and that the nightclub was being evicted despite signing a lease that locked the club’s location in for the next ten years.

Less than a year old, The Act owners believe that they have every right to provide an adult-themed show. They claim that the performance’s material is merely suggestive; however, the casino believes that it is a violation of obscenity laws and is using such to cry breach of contract. The Act also claims that the infringement is contrived given that casino executives had visited and watched their show a number of times without alerting the club to any grievances that they may have had with the show’s theme. In fact, The Act claims that the casino was always conscious of the nightclub’s adult angle.
