Understanding Nevada’s Uniform Trade Secrets Act

For years, the Aldrich Law Firm has been helping Las Vegas business owners protect their intellectual property rights. Because of this we have a great deal of experience with Nevada’s laws on trade secrets, and we bring this extensive knowledge to bear whenever a client is at risk of losing valuable and confidential business information.

Chapter 600A of the Nevada Revised Statutes, which is known as the state’s Uniform Trade Secrets Act, covers the state’s rules and regulations on this category of intellectual property. These laws provide protection for trade secret owners by establishing criminal penalties for those who:

  •          Steal or misappropriate trade secrets
  •          Purchase, possess or receive a trade secret when they knew or had reason to know the information was illegally obtained
  •          Wrongfully communicate or convey trade secrets

An attempt to perform these acts or solicit someone else to perform them is also a crime. In addition, conspiring to commit one of these acts is also punishable under this law if one of the conspirators engages in an action that furthers the conspiracy.

These crimes are all category C felonies. Convictions for these offenses will carry prison sentences for between 1 and 10 years, as well as a possible fine of up to $10,000.

The UTSA also provides trade secret owners with civil remedies against the misappropriation of their intellectual property. In cases involving reckless, wanton or willful misappropriation, courts may choose to add exemplary damages.
