Business faces premises liability lawsuit

With premises liability cases, each set of circumstances is unique. Sometimes, people are hurt after falling down or suffering an injury because of the negligence of another. At the same time, some premises liability cases are fraudulent and can have a devastating impact on businesses and individuals who have been falsely accused. A woman claims that her son was hurt when the two were leaving a business in West Virginia. In the woman's complaint, she alleges that a stick impaled her son's foot, resulting in nerve damage, pain and continuous medical expenses. The woman also claims that the accident, which occurred on a sidewalk outside of the business, has left her son with lasting harm which requires a prosthetic device.

In the woman's lawsuit, she alleges that one of the store's workers informed her son of the hazard, which was caused by debris left behind by an individual who was trimming trees. A jury trial has been sought and the plaintiffs are asking to receive compensation for pain and medical costs.

Although civil litigation cases can be challenging, people who carefully assess the details surrounding their case and put their best foot forward in court may be able to obtain a more favorable outcome. For some, consulting an attorney who is very experienced with these types of cases could be helpful.
