Company sues similarly named business for trademark infringement

In today’s marketplace, having a name that is easily recognizable and that stands apart from the crowd is important for businesses in Las Vegas. When a competitor comes along with a name that is too similar to yours, real problems can be created because your customers may confuse your competition with you.

This is the case for an online store called Just Fab that sells shoes and apparel. The company is concerned that its customers could be confused by another company with a similar name of Fab.com. The two online brands offer customers similar products, including a lot of the same brands. Both companies have predicted that this year they will each bring in $250 million in revenues.

Just Fab recently filed a lawsuit against Fab.com for trademark infringement because they said their name was too similar and could confuse customers. They are also suing for unfair competition. This comes as Just Fab is making plans to expand its business outside of the United States. The company has already taken steps to ensure it won’t be confused with other smaller apparel sites that used “Fab” in their name by buying those companies. This is likely not an option with Fab.com because it is currently valued at $1 billion.

If you find your company in a similar situation to this, you may benefit from speaking with a business litigation attorney. An attorney can look over your case and tell you if your concerns are justified and will stand up in court.
